1. Agreement to Terms
By downloading, installing, or using Focu ("the Software"), you agree to be bound by these Terms and Conditions.
2. License Types and Terms
One-Time Purchase License
- Grants a perpetual, personal, non-transferable, non-exclusive license to use the Software
- License remains active indefinitely after purchase
- Requires one-time activation through a license key
- After activation, the Software operates independently of Focu servers
Update entitlements:
- Licenses purchased during v0.x.x (Beta/Early Access):
- Include all future updates and major version upgrades perpetually
- This is our way of thanking early adopters for their support
- Licenses purchased for v1.0.0 and later:
- Include all updates within the purchased major version number
- Major version upgrades (e.g., v1.x to v2.0) may require additional purchase
Subscription License
- Grants a personal, non-transferable, non-exclusive license to use the Software
- License remains active only while subscription payments are maintained
- Requires initial activation through a license key
- Software periodically connects to Focu servers to verify active subscription status
- Access to the Software will be suspended if subscription lapses
- Includes updates as specified in the Software Updates section
Both license types:
- Are limited to macOS devices that you own or control
- Require internet connection for initial activation
3. Software Updates
- Updates within the current major version number are included with both license types
- Major version updates (e.g., from version 1.x to 2.0) may require an additional purchase for one-time license holders
- Major version updates are included for active subscription license holders
- Updates are provided at our discretion and we do not guarantee the frequency or availability of updates
- Internet connection is required to download and install updates
4. Trial Period
- A 3-day trial period is provided for evaluation purposes
- No purchase is required during the trial period
- Full functionality is available during the trial
5. System Requirements and Connectivity
- The Software requires macOS (minimum version requirements as specified on the website)
- Internet connection is required for:
- Initial license activation
- Downloading AI models through third-party open-source tools (such as Ollama)
- Using optional cloud-based features or third-party APIs (if applicable)
- The Software uses open-source components that may have their own terms and conditions
6. Third-Party Services and APIs
- Users may provide their own API keys for third-party services
- Users are responsible for:
- Compliance with terms of any third-party services they use
- Any costs associated with third-party API usage
- Maintaining the security of their API keys
7. Payments and Refunds
- The Software is available either as a one-time purchase or subscription
- Subscription payments are processed according to the chosen billing cycle
- Due to the provision of a trial period, refunds are generally not provided
- Refund requests may be considered on a case-by-case basis at our discretion
8. Limitations of Liability
- The Software is provided "as is" without warranty of any kind, either express or implied
- This includes third-party components, AI models, and API services used within the Software
- Focu is not responsible for any costs, damages, or issues arising from the use of third-party services
9. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the Software following any changes constitutes acceptance of the modified terms.
